Terms of Use

Welcome to Helibrain! These Terms of Service (“Terms”) govern your use of Helibrain, including its features such as questionnaires, habit tracking, and any other functionality provided.

By accessing or using Helibrain, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue using the app.

1. Acceptance of Terms

You must:

- Be at least 18 years old or meet the age of majority in your jurisdiction.

- Read, understand, and accept these Terms and our Privacy Policy.

If you disagree with any part of the Terms or the Privacy Policy, you may not access the service.

2. User Responsibilities

You agree to:

- Use the app lawfully and in accordance with these Terms.

- Not misuse the app or engage in any activity that disrupts or harms the services.

- Keep your account credentials secure and notify us immediately of unauthorized access.

Prohibited actions include:

- Copying, modifying, or reverse-engineering the app.

- Reselling or redistributing the app or its features.

- Uploading harmful or illegal content.

3. Purpose of the Service (Non-Medical)

The Helibrain service is provided for educational purposes only. It is not a substitute for medical advice, diagnosis, or treatment.

- Do not use Helibrain for medical decisions without consulting a licensed healthcare provider.

- Recommendations and insights provided (e.g., well-being suggestions, habit guidance, meal plans) are general and non-diagnostic.

- Cognitive test results and trends are for educational purposes only and are not medical diagnostics.

- Health metrics read from Apple Health or Health Connect (such as sleep, HRV, and resting heart rate) and any recovery status derived from them are informational only — they are not medical measurements, diagnoses, or alerts, and must not be used to make medical decisions.

4. Features of the Service

4.1 Questionnaire: You may answer questions to receive tailored suggestions.

4.2 Habit Tracking: Track recommended or custom habits, reminders, and progress.

4.3 Nutrition Logging: Log meals via photos/text and receive scores/tips.

4.4 AI Coach Chat: Interact with an AI-powered brain health coach that can answer questions, log meals, track habits, set calorie goals, discuss your cognitive assessment results, and provide personalized food recommendations on your behalf. The AI coach is powered by third-party AI services (third-party AI service providers). AI responses are generated automatically and may not always be accurate or complete — they are for informational and educational purposes only and do not constitute medical, nutritional, or professional advice. Always verify important information and consult a healthcare provider for medical decisions.

4.5 Self-Experiments: Run short, time-boxed experiments with daily check-ins (did-it status, reasons, ratings, notes) and end-of-experiment insights.

4.6 Cognitive Assessments: Take short cognitive tests (reaction time, self-control, working memory, reasoning, and creativity) and view your results and trends over time. Cognitive tests and scores are for educational purposes only — they are not medical diagnostics, do not produce an IQ score, and must not be used for clinical, employment, or other evaluative decisions. Individual sessions naturally vary with factors such as sleep and fatigue. The creativity test is scored with the help of third-party AI services.

4.7 Health Data Integration: Optionally connect Apple Health (iOS) or Health Connect (Android) to see your sleep, HRV, and resting heart rate in the app, along with a daily recovery status based on your own baseline, sleep/HRV trends, associations with your cognitive results, a recovery contribution to your Brain Score, and objective comparisons in experiment summaries. Access is read-only and controlled by the permissions you grant; you can disconnect at any time in Profile → Connections. Derived indicators (such as the recovery status) are heuristics computed from your own data — they are informational only and not medical advice.

5. Account Creation and Termination

- To use Helibrain, you must create an account with a valid email and password or register via Google or Apple Sign In.

- You may delete your account at any time via the app or by contacting us.

We reserve the right to terminate or suspend your account without prior notice if you breach these Terms.

6. Subscriptions, Billing & Free Trials

(a) **Auto-renewal.** Premium is offered as an auto-renewing subscription (e.g., $6.99/month or $29.99/year) billed by **Google Play** (Android) or **App Store** (iOS). Your plan renews automatically at the end of each period unless canceled at least 24 hours before renewal.

(b) **Free trial.** If you start a 7-day free trial, you won’t be charged until it ends. Unless you cancel in the app store before the trial ends, your plan converts to a paid subscription and the first period will be charged. Trials may be limited to first-time subscribers.

Deleting the app or your Helibrain account does **not** cancel billing.

(d) **Pricing & taxes.** Prices are shown in your local currency and may include taxes. We may change prices or plans; any change applies on your next renewal, with notice where required.

(e) **Refunds.** Subscription charges are generally non-refundable. Refund requests are handled by the app store per its policies and applicable law.

(f) **Entitlements / Restore.** A valid store receipt is required to unlock Premium across devices. Use “Restore purchase” in the app to reactivate entitlements on a new device.

(g) **Promotions.** Intro offers and trials are at our discretion and may have eligibility limits to prevent abuse.

7. Free and Premium Tiers

Helibrain offers a free tier with limited access to certain features, including habit and experiment tracking, meal logging, and AI coach messages. Current free-tier limits are displayed within the app and may change at any time.
Premium subscribers receive expanded access to features as described within the app. Subscription terms are described in Section 6.
We reserve the right to adjust free-tier limits at any time.

7A. Lifetime In-App Purchases

In addition to the auto-renewing subscription described in Section 6, we offer one-time non-consumable in-app purchases that grant permanent access to specific features. These purchases:

- Are billed once by **Google Play** (Android) or **App Store** (iOS); no recurring charges.

- Grant access **forever** to the unlocked feature on your Helibrain account.

- Are restorable on any device where you sign in with the same Helibrain account, via "Restore purchase" in the app.

- Are generally non-refundable. Refund requests are handled by the app store per its policies and applicable law.

The currently offered lifetime purchase is:

- **Unlock all recommendations** — a one-time purchase that grants permanent access to every premium recommendation. Which recommendations you see is shaped by your questionnaire answers and may evolve as we add new content or refine matching; the unlock covers every premium recommendation surfaced to you, now and in the future. Sold separately from the Premium subscription; owning the subscription does not include this unlock, and owning this unlock does not include the subscription.

8. AI-Generated Content Disclaimer

The AI coach feature uses artificial intelligence to generate responses. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or outdated information.

You should:

- Not rely solely on AI responses for health, dietary, or medical decisions.

- Verify any important information independently.

- Consult qualified professionals for medical, nutritional, or mental health advice.

We are not liable for actions taken based on AI-generated responses.

9. Limitation of Liability

To the fullest extent permitted by law:

- Helibrain is provided “as is” and “as available” without warranties of any kind.

- We make no guarantee regarding accuracy, completeness, or availability of the service.

- We are not responsible for any:

- Loss or damage arising from reliance on our recommendations.

- Emotional distress caused by insights provided.

- Indirect, incidental, or consequential damages (e.g., loss of data, profits, or personal harm).

Cap on Liability: Our total liability for claims arising out of your use of the service is limited to USD $3 or the amount you paid to use the service in the past 12 months, whichever is greater.

10. Third-Party Links

The app may include links to third-party websites or services. We are not responsible for their content, practices, or policies. Your use of such links is at your own risk.

11. Modifications to the Terms

We reserve the right to update or change these Terms at any time. Changes take effect upon posting the updated Terms in the app. You are responsible for reviewing the Terms periodically to stay informed.

If you continue to use Helibrain after any changes, you accept the updated Terms. If you disagree, you must stop using the app and delete your account.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Serbia, without regard to its conflict of law provisions.

Any disputes arising under these Terms will be resolved in the courts of Pančhevo, Serbia, unless otherwise required by local laws in your jurisdiction.

13. User Rights under GDPR and CCPA

If you are a resident of the EU or California, you have rights regarding your personal data, as outlined in our Privacy Policy. These include:

- Access to your data.

- Correction or deletion of your data.

- Opting out of data processing or sales (we do not sell your data).
